Fence Construction Warranty
(A) Coverage:
(1A) - This warranty covers all necessary repairs to the fence constructed by J.R.’S Son’s Fence, LLC., for a period of one (1) year from the date of completion, provided that such repairs are not attributable to damage caused by the property owner or any third party.
(B) Scope:
J.R. & Sons Fence, LLC shall provide all labor, tools, equipment, and materials necessary to complete the fence installation as outlined in the attached project proposal or as otherwise agreed upon in writing by both Parties. All work shall be performed in accordance with industry standards, applicable local building codes, and safety regulations.
Unless explicitly requested in writing by the Client, pre-manufactured or pre-assembled materials—such as aluminum panels, vinyl panel systems, and pre-made wood picket sections—will not be used. The Contractor specializes in custom-built fencing solutions and assumes no responsibility or warranty for the performance, durability, or defects of pre-manufactured products if selected by the Client.
Standard work hours are Monday through Saturday, 7:00 AM to 3:00 PM. The Client shall ensure that the Contractor and crew have safe and unobstructed access to the job site, as well as access to a functional electrical outlet and water source throughout the duration of the project. Upon completion of the project, the site will be cleaned up to the best of the Contractor’s ability, with debris and excess materials removed unless otherwise specified.
(C) Exclusions:
Unless specifically stated in writing within the project proposal or agreed upon by both Parties, the following are expressly excluded from the scope of work:
Removal or relocation of existing structures, fencing, or landscaping unless otherwise noted
Grading, excavation beyond post hole depth, or drainage correction
Permits, inspections, or fees required by local authorities
Painting, staining, or sealing of materials after installation
Electrical work, including gate motors or lighting
Hauling of excess debris unless specified
Work on or near utility lines unless properly marked and cleared
Pre-manufactured materials, such as aluminum fence panels, vinyl panel systems, and pre-made wood picket sections, are not included in this contract and will not be used unless explicitly requested by the Client in writing. These items are excluded from any workmanship or product warranties.
(D) Claims Process:
(1D) - To make a warranty claim, the property owner must notify J.R. & Son’s Fence, LLC., in writing within a reasonable time after discovering the defect. Upon receipt of the claim, J.R.’S Son’s Fence, LLC., will promptly inspect the fence and determine the appropriate course of action to remedy the issue.
(E) Limitation of Liability:
J.R. & Sons Fence, LLC shall not be held liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of use, loss of time, inconvenience, loss of profits, or property damage, arising out of or related to the performance or non-performance of any work or warranty obligations. This limitation applies regardless of the cause, including negligence, and applies to the fullest extent permitted by law. Nothing in this section shall be construed to limit liability where such limitation is prohibited by applicable law.
J.R. & Sons Fence, LLC does not warranty pre-manufactured or pre-assembled materials, including but not limited to aluminum fence panels, vinyl panel systems, and pre-made wood picket sections. These materials are only used upon explicit request by the Client, and the Contractor assumes no responsibility for defects, deterioration, or performance of such products once installed.
(F) Governing Law:
(1F) - This warranty shall be governed by and construed in accordance with the laws of [State/Country], without regard to its conflict of law principles.
(G) Disclaimer:
(1G) - This warranty constitutes the entire agreement between the property owner and J.R. & Son’s Fence, LLC., regarding the fence construction and supersedes all prior or contemporaneous agreements and understandings, whether written or oral.
(H) Effective Date:
(1H) - This warranty shall take effect upon the completion of the fence construction and shall remain in force for a period of one (1) year thereafter.
1. Scope of Work:
The Contractor shall perform all labor, material procurement, and installation necessary to complete the fence installation as specified in the attached project proposal or as otherwise documented and agreed upon in writing by both Parties. All work will be completed in accordance with industry standards.
2. Payment Terms:
The Client agrees to pay the Contractor the total sum of [Total Amount] for the completion of the services described above. A non-refundable down payment of [Down Payment Amount] is required to secure the project start date and materials. If the Client cancels the project within seven (7) calendar days of the projected start date, the down payment shall be non-refundable. If the project is canceled prior to the seven-day window, the Client is eligible for a 50% refund of the down payment.
Final payment is due in full within seven (7) calendar days of the project's completion. If full payment is not received by the eighth day, a late fee of 10% per week will be applied to the outstanding balance until paid in full. The Contractor reserves the right to initiate collections proceedings for any unpaid amounts, and the Client shall be responsible for all related costs, including attorney’s fees, court costs, and administrative fees.
3. Late Payment:
Payment in full is due within seven (7) calendar days from the date of project completion. If the Client fails to pay within this period, the Contractor reserves the right to initiate formal collections proceedings without further notice. In addition, the Client agrees to pay interest on the unpaid balance at a rate of 10% per week, beginning the day after the due date and continuing until the balance is paid in full. The Client shall also be liable for all costs associated with the collection of the outstanding balance, including but not limited to attorney’s fees, court costs, and administrative fees.
4. Attorney Fees:
The Client shall be responsible for all reasonable attorney fees, costs incurred by the Contractor in connection with the enforcement of this agreement, including but not limited to collections efforts.
5. Governing Law:
This agreement shall be governed by and construed in accordance with the laws of New Mexico, USA, without regard to its conflict of law principles.
6. Entire Agreement:
This agreement constitutes the entire understanding between the Parties with respect to the subject matter hereof and supersedes all prior agreements, negotiations, and discussions, whether oral or written.
